San Antonio Senator Introduces New and Improved Medical Marijuana Bill

Texas Medical Marijuana Laws

Texas’ medical marijuana law only allows for limited CBD oil with trace amounts of THC, which has led one San Antonio lawmaker to call the law useless. Senator Jose Menendez filed a bill for the new session to bring a more progressive medical marijuana law to Texas. The goal is to model the program after other existing programs that allow for a wide variety of medical marijuana products, such as flower, concentrates, and edibles.

Doctors have to prescribe medical marijuana to patients in Texas; whereas, other states allow doctors to recommend medical marijuana, reports the San Antonio Current. Given that marijuana is still a Schedule I drug, some doctors are hesitant to prescribe medical marijuana for fear of losing their licenses. Senator Menendez’s bill, Senate Bill 269, aims to fix issue.

The Democratic Senator is introducing the bill because patients and veterans have asked for access to medical marijuana.

Senator Menendez said, “Doctors, not politicians, should be determining what is best for Texas patients. This is legitimate medicine that can help a variety of sick people, from the grandmother suffering from cancer to the veteran coping with PTSD after returning home from war.”

Marijuana reform activists are also attempting to lessen the state’s criminal penalties for simple marijuana possession as Texas has some of the harshest criminal penalties in the country.
