Texas is hoping to make millions from CBD. And to legalize it, lawmakers created new law, HB 1325, to test for the THC amounts between legal hemp and illegal marijuana.
Lawmakers were unaware that Texas crime labs lack the necessary equipment to test the concentration of THC in a plant sample, according to ABC 13 News. To qualify as hemp under federal law, samples cannot test above 0.3% THC.
The new law will require that testing equipment is upgraded to be able to determine actual concentrations of THC to determine if a sample is hemp or marijuana.
